STONE ROSE Valentines Day Sweepstakes (the “Sweepstakes”) Official Rules
NO PURCHASE, TRANSACTION OR OBLIGATION NECESSARY TO ENTER. A PURCHASE, TRANSACTION OR OBLIGATION DOES NOT INCREASE YOUR CHANCES OF WINNING. OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES & THE DISTRICT OF COLUMBIA, 18 YEARS OF AGE AND OLDER AT TIME OF ENTRY. VOID WHERE PROHIBITED.
1. SPONSOR: Stone Rose, LLC (“Sponsor”)
2. ELIGIBILITY: The “Valentines Day Sweepstakes” (the “Sweepstakes”) is open to: legal residents of the 50 United States and D.C, who are at least 18 years of age or older as of the time of entry. Employees, contractors, directors, officers, and agents of Sponsor, or any advertising, promotion and judging agencies or all other service agencies involved with the Sweepstakes, as well as their affiliates, subsidiaries, representatives and agencies (collectively "Sweepstakes Parties"), and members of their immediate family (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and/or (whether or not related) are not eligible to enter or win.
Sponsor reserves the right to disqualify participants who violate these official rules (the “Official Rules”) or interfere with the Sweepstakes in any manner. If a participant is disqualified, Sponsor reserve the right to terminate that participant’s eligibility to participate in this Sweepstakes. Void where prohibited or restricted by law. This Sweepstakes is subject to all federal, state, and local laws and regulations.
3. PROMOTION PERIOD: The Sweepstakes begins at 12:00:00am Eastern Time (ET) on January 25, 2023 and ends at 11:59:59pm (ET) on February 6, 2023 (the “Promotion Period”). The Sponsor runs the official clock for the Sweepstakes and will solely determine the time by which an entry is received.

5. PRIZE: ONE (1) Grand Prize Winner will receive (i) a $250 gift card to restaurant of their choice (ii) and $150 gift card to Stone Rose website at www.stonerose.com

No transfer or cash or other substitution of all or part of a prize is permitted, except by Sponsor, which reserves the right, in its sole discretion, to substitute the prize or prize component with another of comparable or greater value. Sponsor shall not be responsible for any delays, damage in the delivery of the prize, and/or loss of any prize in connection with delivery of the prize via mail.
Odds of winning a Prize depend on the total number of eligible entries received. No more than the stated number of Prizes above will be awarded. Winners are responsible for the payment of all federal, state and local taxes on the Prize. All prize details are at Sponsor’s sole discretion.
6. WINNER SELECTION:
ONE (1) Grand Prize Winner(s) will be selected in a random drawing on or about February 7, 2023 from all eligible entries received by the entry deadline. Winners will be notified via email and must respond to email notification within two (2) days of receipt. Winners may also be required to complete, execute and return an Affidavit of Eligibility and Release. Noncompliance with these conditions may result in forfeiture of the Prize, and Sponsor reserves the right to select alternate winners (in random drawing from other eligible entries received before the deadline) in such circumstance. If winner notification of the Prize is returned as undeliverable, Sponsor may, at its discretion, select an alternate winner. Upon prize forfeiture, no compensation will be given. Winner will also be announced on our Official Stone Rose Instagram account. This Promotion is not sponsored, produced, executed, or administered by Instagram.
7. DISCLAIMER
By competing in this Sweepstakes and/or accepting the prize, entrants agree that Sponsor, and its respective parent companies, assigns, subsidiaries and affiliates, and advertising, promotion and fulfillment agencies and all of their respective employees, officers and directors will have no liability whatsoever, and will be held harmless by entrants for any liability for any injuries, losses, or damages of any kind to person and property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse, or use of the prizes, or participation in this Sweepstakes. By accepting a prize, each Winner consents to the use of his/her name for publicity and promotional purposes on behalf of Sponsor with no additional compensation or further permission (except where prohibited by law).
8. GENERAL CONDITIONS
In the event of a dispute, entries will be deemed made by the authorized account holder of the email address used for entry. Automated entries are prohibited, and any use of automated devices will result in disqualification. Sponsor is not responsible for incorrect or inaccurate entry of information by entrants; lost or late entries or transmissions; interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions of any computer hardware, software, or any combinations thereof; or problems associated with any virus or any other damage caused to entrants’ systems. Incomplete or illegible entries will be voided. All entries become the property of Sponsor. If for any reason the Sweepstakes is not capable of being conducted as described in these rules, Sponsor shall have the right to cancel, terminate, modify or suspend the Sweepstakes.
9. LIMITATION OF LIABILITY: UNLESS PROHIBITED BY LAW, IN NO EVENT WILL THE RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND/OR PARTICIPATION IN THE SWEEPSTAKES, INCLUDING BUT NOT LIMITED TO DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES.
10. PRIVACY
Any information you provide to Sponsor may be used to communicate with you in relation to this Sweepstake or on a Sweepstakes Winner’s list. By entering the Sweepstakes, you agree to receive email newsletters periodically from the Sponsor. You can opt-out of receiving these emails at any time by clicking the unsubscribe link in the newsletter. Information submitted in connection with the Sweepstakes will be treated in accordance with the Sponsor’s Privacy Policy located at https://stonerose.com/pages/legal
11. ARBITRATION
These Rules shall be governed by, and construed in accordance with, the laws of the state of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the Sponsor location.
Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes shall be resolved by binding arbitration, without resort to any form of class action, and exclusively by the appropriate court located in the giveaway home location. The parties agree to follow the arbitration procedures set forth by the American Arbitration Association (AAA) to resolve the dispute. Arbitration proceedings shall take place in the Giveaway home location. Each party is responsible for paying its own filing, administrative and arbitrator fees. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.
12. GOVERNING LAW & JURISDICTION
It is acknowledged that this Agreement is executed in and shall be construed and governed exclusively by and in accordance with the laws of the State of Florida. The state courts in Miami County, Florida, shall have exclusive jurisdiction over any controversy between the parties arising out of or related to this Agreement.
